These Terms and Conditions (“Terms”) govern access to and use of the SixApp mobile application, website at sixapp.eu and related marketplace services (collectively, the “Platform”). Please read them before creating an Account or using the Platform.
These Terms create a legally binding agreement between each User and:
Sabiedrība ar ierobežotu atbildību “SIX” (SIA “SIX”)
Registration No.: 40203724461
Legal address: Cietokšņa iela 15-6, Daugavpils, LV-5401, Latvia
Website: sixapp.eu
Email: info@sixapp.eu
(“SixApp”, “we”, “us” or “our”).
The Platform connects Customers who request short, on-demand Tasks with independent Performers who choose whether to submit Offers. Two distinct contractual relationships may arise: the platform agreement between the User and SixApp, governed by these Terms; and the Task Agreement directly between the Customer and the selected Performer, consisting of the Task Description, accepted Offer and applicable terms displayed at Checkout.
SixApp is not the provider of the Task and is not a party to the Task Agreement. SixApp provides the Platform and facilitates payment through authorised third-party payment providers. The allocation of responsibilities between SixApp and the Performer is displayed before the Customer pays.
By creating an Account, accepting these Terms or continuing to use the Platform after being given legally sufficient notice of an update, you agree to these Terms. Additional affirmative confirmations are required where applicable, including for payment, early commencement of a consumer service, identity or tax verification, and specific Promotions. If you do not agree, you must not use the Platform.

2. Eligibility and account
Eligibility
A natural person must be at least 18 years old and legally capable of entering into binding contracts to create or use an Account. A legal person may use the Platform only through a representative who is at least 18 years old and has authority to bind that legal person.
The Platform currently facilitates Tasks performed in Latvia. Access, payment methods, and payouts may be limited by supported territories, applicable law, sanctions, verification requirements, and payment-provider availability.
Accurate information and account capacity
You must provide accurate, complete, and current information and promptly update it. SixApp may request reasonable evidence of identity, age, address, authority, business registration, tax residence, VAT status or other information required for safety, payment, consumer protection, DSA, P2B, or DAC7 compliance.
A Customer must declare whether the Customer is acting as a Consumer or Business Customer. A legal person is treated as a Business Customer. The declared capacity may be requested at Account level or for an individual Task and must reflect the actual circumstances.
A Performer must declare whether the Performer acts as a Trader or Non-Trader. A legal person is treated as a Trader. The Performer must update the declaration if the nature or regularity of the activity changes.
Before the Customer becomes bound, Checkout will display the Performer's declared status. Where the Performer is a Non-Trader, Checkout will warn a Consumer that EU and Latvian consumer-protection rules governing contracts with traders generally do not apply to the Task Agreement. The warning does not affect rights against SixApp in relation to SixApp's own platform service.
Where the Performer is a Trader, the Performer must provide the business and contact information required by law. SixApp may verify that information before allowing the Trader to offer Tasks and may display the legally required information to Customers.
A status declaration does not conclusively determine a person's consumer, tax, business, employment or social-security status. Applicable law and the actual circumstances prevail.
Account integrity
You must not impersonate another person, use another person's Account, provide misleading information, create duplicate Accounts to obtain Promotions or evade restrictions, or allow another person to perform regulated or identity-dependent activity through your Account.
You are responsible for protecting your credentials and for activity carried out through your Account, except to the extent caused by a security failure attributable to SixApp or another circumstance for which liability cannot lawfully be excluded. Notify SixApp without undue delay of suspected unauthorised access.
SixApp may refuse registration or proportionately restrict an Account where required information cannot be verified, where the Account creates a material safety, fraud, payment or legal risk, or on another ground expressly stated in these Terms. Sections 14 and 23 govern notices, reasons and review rights.
Business users
A Trader Performer may qualify as a business user under Regulation (EU) 2019/1150. Sections 6, 23 and 25 provide information concerning ranking, data access, restrictions, termination and changes applicable to business users.
3. The role of SixApp
Marketplace platform
SixApp operates a technology platform that enables Customers to post Tasks and Performers to submit Offers to perform those Tasks. SixApp facilitates communication between Users, Task selection, payment processing and, where applicable, dispute resolution in accordance with these Terms.
SixApp does not itself perform, provide or supervise Tasks and is not a party to the agreement between a Customer and a Performer for the performance of a Task. Unless expressly stated otherwise in these Terms, SixApp does not guarantee the availability, quality, legality, suitability or outcome of any Task or the conduct, qualifications or performance of any User.
SixApp's role in facilitating payments or resolving disputes does not make SixApp a party to the agreement between the Customer and the Performer and does not create an employment, agency, partnership or other similar relationship between SixApp and any Performer or Customer.
Unless expressly stated otherwise in relation to a particular service, SixApp does not itself perform any Tasks offered through the Platform.
Performers act as independent service providers and are solely responsible for the manner, means, quality and performance of the Tasks they accept. SixApp does not employ, engage, supervise or control Performers as employees and does not direct how a Performer performs a Task, subject always to mandatory requirements of applicable law.
Nothing in these Terms creates an employment, agency, partnership, joint venture or other similar relationship between SixApp and a Performer.
SixApp is not the Customer requesting a Task and does not purchase, acquire or use the services offered by Performers for its own purposes. The agreement for the performance of a Task is concluded directly between the Customer and the selected Performer, in accordance with these Terms and the specific Task and Offer accepted through the Platform. SixApp acts solely as the Platform facilitating the interaction and transaction between Users.
Independent relationship between Users
The Performer acts as an independent service provider and not as an employee, worker, agent, representative or contractor of SixApp. This contractual description does not exclude or determine any employment or other legal status that may arise mandatorily under applicable law based on the actual circumstances of the relationship.
The Task Agreement is concluded directly between the Customer and the selected Performer when the Customer selects the Performer and completes payment through the Platform.
SixApp is not a party to the Task Agreement and does not assume responsibility for the Performer's performance, acts or omissions, the quality or outcome of the Task, or any agreement between the Customer and the Performer, except for obligations expressly assumed by SixApp under these Terms or applicable law.
No guarantee of outcome
SixApp does not guarantee:
- that a Task will receive any Offers or that any Offer will be suitable for the Customer;
- that a Customer will find or select a suitable Performer;
- that a Performer will be selected or receive any Task;
- that any User will be satisfied with another User or with the outcome of a Task;
- that a Performer will accept, commence, complete or successfully perform a Task;
- that any User is trustworthy, reliable, qualified, experienced, licensed, insured or otherwise suitable for a particular Task; or
- that any information, profile, Offer, review or other content provided by a User is accurate, complete or reliable.
Where SixApp or a third-party provider performs any identity, age or other verification, such verification confirms only the information or criteria specifically verified and does not constitute a certification, endorsement or guarantee of the User's qualifications, competence, conduct, reliability, legality, insurance coverage or future performance.
Users are responsible for conducting their own assessment and, where appropriate, requesting any additional information, qualifications, licences or other evidence they consider necessary before entering into a Task Agreement.
4. Users' responsibilities
Each User is solely responsible for their own conduct, actions and omissions in connection with the Platform and any Task, and for complying with these Terms and all applicable laws and regulations.
Users must:
- communicate honestly, accurately and respectfully with other Users;
- provide accurate, complete and non-misleading information concerning their Account, Tasks and Offers;
- ensure that any Task they post or accept is lawful and within their ability and authority to perform;
- comply with agreed Task requirements, deadlines, prices and other conditions;
- use the Platform and its payment functionality only for lawful and permitted purposes;
- cooperate reasonably and in good faith with other Users and SixApp, including in connection with disputes or requests for information;
- provide truthful, accurate and authentic evidence when evidence is requested;
- take reasonable care to avoid causing harm, fraud, harassment, abuse or unreasonable risk to other Users; and
- comply with any reasonable safety, verification and other requirements applicable to their use of the Platform.
Users must not use the Platform to circumvent applicable law, payment or tax requirements, safety rules, these Terms, Platform restrictions or enforcement measures, including by moving Tasks or payments off the Platform for the purpose of avoiding applicable fees, controls or dispute procedures.
A User remains responsible for their own legal, tax, licensing, insurance and other obligations arising from their activities on the Platform. SixApp does not assume responsibility for a User's compliance with such obligations.
5. Tasks
Posting a Task
A Customer may post a Task by providing the information requested by the Platform. The Customer is solely responsible for the accuracy, completeness and legality of the Task and all information provided in connection with it.
The Customer must provide a clear, accurate and sufficiently complete Task Description so that a reasonably informed Performer can understand the nature, scope, requirements and expected result of the Task before submitting an Offer.
Depending on the category or nature of the Task, SixApp may require additional information, including: location; deadline or required completion time; expected result or deliverables; photographs or other relevant materials; price or budget; evidence or completion requirements; special instructions, conditions or limitations; and applicable cancellation terms.
The Customer must not omit or misrepresent material information, impose requirements that were not disclosed before the Performer accepts the Task, or use a Task Description that is misleading, unlawful or reasonably likely to create an unsafe or materially unfair situation for a Performer.
SixApp may require a Customer to provide additional information, clarify or amend a Task Description, or may refuse, restrict or remove a Task where reasonably necessary under these Terms or applicable law.
Task scope
The Task Description, the selected Offer and any other terms expressly accepted by both the Customer and the Performer through the Platform form the agreed scope and terms of the Task and constitute the primary basis for determining the rights and obligations of the parties in relation to that Task.
Any material change to the scope, requirements, deadline, price or other material terms of a Task after the Task Agreement has been formed must be agreed by both the Customer and the Performer through the Platform. A Performer is not required to perform additional work that was not included in the agreed Task scope unless the Performer agrees to the change.
A User must not unilaterally impose additional requirements, remove agreed requirements or materially change the Task after acceptance. Any agreement or instruction made outside the Platform may not be taken into account by SixApp when resolving a dispute where it cannot be reliably verified.
For the avoidance of doubt, the original agreed Task scope will not be replaced merely by subsequent informal communications or unilateral expectations of either User.
Prohibited Tasks
SixApp may reject, refuse to publish, remove, restrict, suspend or cancel a Task on objective and proportionate grounds where the Task:
- is illegal or facilitates unlawful activity;
- is unsafe or creates an unreasonable risk of harm to any person or property;
- involves weapons, ammunition or explosives;
- involves illegal drugs, controlled substances or other prohibited substances;
- involves sexual services, sexual exploitation or exploitative sexual activity;
- involves the exploitation, abuse or endangerment of minors;
- requires medical, legal, financial or other regulated professional advice or services;
- requires a regulated licence, qualification, authorisation or certification that cannot reasonably be verified;
- involves fraud, deception, money laundering, sanctions evasion or other unlawful activity;
- involves the handling, transportation, purchase or delivery of prohibited, hazardous or dangerous goods;
- infringes or may materially infringe the rights of another person, including intellectual property, privacy or other legal rights;
- creates a material safety, insurance, regulatory or liability risk for SixApp or Users; or
- otherwise violates these Terms, applicable law or Platform rules or policies.
This list is not exhaustive. SixApp may prohibit, restrict or require additional safeguards for other categories of Tasks where reasonably necessary to protect Users, comply with applicable law, respond to safety or liability risks, or protect the security and integrity of the Platform.
SixApp does not undertake to identify or prevent every prohibited or unlawful Task and does not guarantee that all Tasks available through the Platform comply with applicable law.
Where a Task is rejected, removed, restricted or cancelled under this section, SixApp may also suspend or restrict the relevant Account and may withhold, refund or otherwise handle any related payment in accordance with these Terms and applicable law.
No obligation to accept a Task
A Performer is free to decide whether to submit an Offer for a Task and is solely responsible for the terms, price, availability and conditions stated in that Offer.
A Customer is free to choose among available Offers, subject to Platform functionality, these Terms and applicable law. The Customer is responsible for assessing the suitability of a Performer and Offer before making a selection.
SixApp does not guarantee that any Task will receive Offers or that any Offer or Performer will be suitable for the Customer, and the availability or display of an Offer or Performer on the Platform does not constitute an endorsement, recommendation or guarantee by SixApp.
6. Offers and ranking
Submitting and accepting Offers
A Performer may submit an Offer stating the Performer Amount, availability, expected completion time and any material conditions. By submitting an Offer, the Performer confirms having the ability, authority, time, licences and resources reasonably required for the Task.
An Offer must be accurate and include all charges the Performer expects the Customer to bear for the agreed scope. A Performer must not demand additional payment after acceptance unless the Customer expressly approves a material change through the Platform before the additional work or cost is incurred.
The Customer may compare available Offers and freely select a Performer. SixApp does not guarantee that a Task will receive an Offer or that a particular User is suitable.
An Offer remains available until accepted, withdrawn, expired, the Task is cancelled or the time shown in the Platform passes. The Performer must withdraw an Offer that can no longer be honoured.
Ranking and recommendations
SixApp may rank or recommend Tasks, Offers and Performers to make the Platform useful and relevant. The principal parameters may include: category and search relevance; distance or location; availability and deadline compatibility; price; rating and review history; completion, cancellation and response history; recency; safety, fraud and policy signals; and the User's filters or stated preferences.
Relevance, location and timing are generally the most important parameters for on-demand Tasks. Price, reliability and ratings are generally secondary parameters. Recency, activity and other signals may be used as tie-breakers or to improve diversity and availability. Fraud, safety or legal restrictions may override other factors.
SixApp does not offer paid ranking unless the Platform clearly identifies the paid placement and explains its effect. A Promotion or lower Platform Fee does not improve ranking unless expressly disclosed.
Users may apply available filters and may choose any eligible Offer regardless of its position. SixApp may update ranking parameters to improve relevance, prevent manipulation or comply with law. Material changes affecting business users will be notified under Section 25.
Business users may request additional information reasonably necessary to understand the operation of the main ranking parameters, subject to protection of trade secrets, security and anti-manipulation measures.
SixApp may give different treatment to its own services or those of a controlled business only if that treatment and its principal commercial or technical basis are clearly disclosed. As of the Effective Date, SixApp does not itself compete as a Performer in ranked Task results.
7. Formation of contracts
Task Agreement
A Task Agreement is formed directly between the Customer and the selected Performer when the Customer selects the Performer and the payment provider confirms successful authorisation or capture of the Customer Total. Until both events occur, neither party may require performance.
The Task Agreement consists of the Task Description, accepted Offer, the Performer's Trader or Non-Trader status, any consumer information shown at Checkout and any later change expressly agreed through the Platform.
The Performer Amount is the contractual consideration payable to the Performer under the Task Agreement. The Platform Fee is separate consideration payable to SixApp for the platform service. The Customer Total is the sum of those amounts and any other charge expressly disclosed at Checkout.
Platform agreement
At the same time, the Customer enters into a contract with SixApp for the platform service associated with the transaction. SixApp's obligations include operating the Checkout and Task record, facilitating payment through the payment provider, providing the review and Dispute workflow, and providing support as stated in these Terms.
Confirmation and changes
Immediately after formation, SixApp will make a confirmation available on a durable medium, normally by email or a downloadable in-app record, containing the material Task terms, the total price, the parties' status, applicable withdrawal information and these Terms or a stable link to the accepted version.
A material change to scope, price, deadline or required expenses must be agreed by both Users through the Platform before it takes effect. Neither User may impose an additional material term unilaterally.
SixApp records the accepted version, time of acceptance, Task terms, payment status, communications and material confirmations for the purposes stated in the Privacy Policy.
8. Pricing, Platform Fee and tax documents
Before the Customer submits the order, Checkout will clearly display: the Performer Amount; the Platform Fee and applicable rate; any VAT or other charge included in or added to an amount; any approved materials or reimbursable costs already known; and the Customer Total.
Unless a different rate is clearly shown before payment, the Platform Fee equals 13% of the Performer Amount and is paid by the Customer on top of the Performer Amount. Amounts are rounded to the nearest cent using the method displayed by the Platform. No undisclosed mandatory charge may be added after the order is submitted.
SixApp may change the Platform Fee prospectively. The rate displayed at Checkout governs that transaction and cannot be increased after the Task Agreement is formed unless the Customer expressly agrees to additional work and the associated updated total.
The Performer is responsible for issuing any invoice, receipt or other tax document legally required for the Task service. SixApp is responsible for any invoice or receipt legally required for the Platform Fee. A payment-provider receipt is not necessarily a tax invoice.
Each User remains responsible for taxes, registrations and social contributions arising from that User's activities. SixApp does not withhold or pay a Performer's personal income tax or social contributions unless mandatory law expressly requires it and the Platform provides advance notice.
The refund treatment of the Performer Amount and Platform Fee is governed by Sections 10 and 11. Mandatory consumer rights prevail.
SixApp does not personalise the Customer Total on the basis of automated decision-making unless Checkout clearly informs the Customer, before the order is submitted, that the displayed price has been personalised and explains this as required by law.
9. Payments and payouts
Payment provider
Payments and payouts are processed by an authorised third-party payment provider, currently Stripe where available. Users may be required to accept the provider's terms and complete identity, business, bank-account, sanctions and other verification.
SixApp does not itself provide regulated payment services, store full card details or operate an escrow account. The payment provider performs authorisation, capture, safeguarding or holding, transfer, payout, refund and chargeback processing under its own regulatory status and terms. SixApp may transmit lawful instructions through the provider's systems in accordance with these Terms.
A Performer must establish and maintain the connected payout account required by the Platform before receiving Performer Amounts or cash-equivalent Promotions. Failure to complete verification may delay or prevent payouts and may require cancellation or refund of an affected Task.
Authorisation and release
The Customer authorises the Customer Total when submitting the order. Depending on the payment method, the provider may capture immediately or later and may place a temporary hold.
Subject to Sections 10 and 11, SixApp will instruct release of the Performer Amount after the Customer confirms completion or the 24-hour Review Period expires without a Dispute. Bank and provider processing times are additional and may be displayed in the payout interface.
SixApp or the payment provider may delay a transaction where reasonably necessary for an open Dispute, refund, chargeback, suspected fraud, safety incident, sanctions screening, required tax or identity information, technical error or legal obligation. The delay does not decide the underlying Task claim.
Refunds, chargebacks and set-off
An approved refund will be initiated without undue delay and ordinarily within five business days after the relevant decision. The Customer's bank or payment method may require additional processing time. A mandatory shorter deadline prevails.
If a payment is reversed, charged back or refunded after a payout because of fraud, duplicate payment, a final Dispute outcome or another legally valid reason attributable to the Performer, the Performer must repay the corresponding amount. To the extent permitted by law and after notice, SixApp may instruct the payment provider to deduct that amount from future payouts. SixApp will not transfer to a Consumer a liability that mandatory law places on SixApp.
Users must not pay or accept payment outside the Platform for a Task matched through SixApp in order to avoid fees, verification, tax reporting, safety controls or the Dispute process. This restriction protects the Platform's legitimate investment in matching, trust, payment and support services and applies only to Tasks introduced through the Platform.
Payment information is processed under the Privacy Policy. SixApp may provide legally required payment and seller information to the payment provider and competent authorities.
10. Performance, completion and disputes
Performance and evidence
The Performer must perform the Task with reasonable care and skill, in accordance with the agreed scope, deadline, applicable law and any standard that a Trader is legally required to meet.
When the Performer considers the Task complete, the Performer must mark it completed and submit the Completion Evidence required for that Task category. The Platform may require camera-only capture to improve authenticity. Evidence must be relevant, truthful and proportionate and should avoid faces, private documents, children, bystanders and sensitive areas unless genuinely necessary and lawful.
Completion Evidence may include photographs, short videos, receipts, delivery or handover confirmation, task checklists, location confirmation and relevant messages. Evidence is assessed together with the Task Description and other records; no single item automatically proves or disproves completion.
Review Period
Once the Customer is notified that the Task was marked complete, the Customer has 24 hours (the “Review Period”) to confirm completion or open a Dispute. The interface will show the end time.
If the Customer takes no action before the Review Period expires, the Task is automatically treated as completed for Platform payment-release purposes and SixApp may instruct release of the Performer Amount. Automatic completion does not waive a mandatory consumer right, a claim based on fraud or latent non-conformity, or another right that cannot lawfully be limited.
Opening and responding to a Dispute
A User opening a Dispute must select the issue, describe the requested outcome and submit available evidence. SixApp will notify the other User and provide a reasonable response period, normally 24 hours. SixApp may extend or shorten a period where reasonably necessary for safety, fraud, technical failure, translation, accessibility or legal requirements.
Both Users must cooperate honestly, preserve relevant evidence and respond within the displayed time. False or manipulated evidence may result in an adverse inference, loss of a Promotion, restriction or termination.
Internal decision
SixApp will assess the agreed scope, timing, messages, Completion Evidence, payment records, each User's submissions and any reliable fraud or technical signals. A material final decision will not be made solely by an automated system.
For payment administration, SixApp may decide to: release the full Performer Amount; refund the full disputed amount; divide the Performer Amount, including a 50/50 allocation where the evidence is materially balanced or that outcome is a reasonable compromise; reimburse verified and previously authorised expenses; request additional performance where both Users agree; or take another outcome required by mandatory law.
A 50/50 allocation is not automatic. SixApp will use it only where supported by the available evidence and circumstances and will give a concise reason for the outcome.
Appeal
Each User may submit one appeal within 24 hours after the first decision, or within a longer period required by law. The appeal must identify a material factual or procedural error or provide material evidence that could not reasonably have been provided earlier.
A different qualified reviewer will consider the appeal where reasonably practicable. The appeal decision is final within the Platform and will include a concise explanation. Payment or refund will then be processed under Section 9.
Legal rights
The Dispute process is an internal payment and support mechanism. It does not prevent a User from negotiating directly, contacting a competent authority, using applicable consumer ADR or bringing a court claim. Mandatory rights and limitation periods are not reduced by the Review Period or appeal deadline.
SixApp may preserve Dispute records and evidence under the Privacy Policy. Users should retain their own records where they may be needed for legal, tax or insurance purposes.
11. Cancellation, refunds and consumer withdrawal
Platform cancellation rules
Before a Performer is selected and payment is successfully authorised or captured, the Customer may cancel without charge and no Task Agreement is formed.
After formation, the following default rules apply unless Checkout clearly disclosed a more favourable rule or mandatory law requires another result:
- if the Performer cancels, fails to attend or cannot lawfully perform, the Customer receives a refund of the Customer Total, except for a separately approved and already delivered item that the Customer keeps;
- if the Customer cancels before the Performer starts travelling, working or incurring an approved cost, the Customer receives a refund of the Customer Total;
- if the Customer cancels after the Performer has started travelling, working or incurred an approved cost, the Performer may receive verified approved costs and a proportionate amount for work actually performed, and the balance is refunded;
- if performance is prevented by the Customer's failure to provide agreed access, information or presence, the outcome is determined on the same proportionate basis after review of evidence; and
- if cancellation is required by an immediate safety risk, illegality, fraud or force majeure, SixApp will allocate the payment fairly in light of work actually performed, verified costs, responsibility for the event and mandatory law.
The Platform Fee will be refunded where the Performer cancels or the Task Agreement is not formed. In other cancellations, SixApp may retain only the amount clearly disclosed before payment and lawfully attributable to the platform service already supplied. Any remaining Platform Fee is refunded. Consumer withdrawal rights prevail.
Materials or other expenses are reimbursable only if the Customer approved them through the Platform before they were incurred, except for a reasonable emergency expense necessary to prevent immediate harm and supported by evidence.
Consumer withdrawal from Trader and SixApp services
Where a Consumer enters into a distance Task Agreement with a Trader, the Consumer generally has 14 days from formation to withdraw without giving a reason, unless a statutory exception applies.
Because Tasks are normally intended to begin promptly, before a Trader starts during the withdrawal period the Platform will require the Consumer to make an express request for early performance and acknowledge that the right of withdrawal is lost once the service has been fully performed. The checkbox or confirmation will not be preselected.
If the Consumer validly withdraws after expressly requesting commencement but before full performance, the Consumer may be required to pay the Trader a proportionate amount for the service actually supplied, provided the legally required information was given. Once the service has been fully performed following the required request and acknowledgement, the right of withdrawal may be lost.
A Consumer may exercise an applicable withdrawal right through the continuously available in-app withdrawal function or by sending an unequivocal statement to info@sixapp.eu. SixApp will promptly acknowledge receipt on a durable medium and forward the statement to the Trader. The model form in Annex 1 may be used but is not mandatory.
A Consumer separately retains any withdrawal right applicable to the transaction-specific platform service supplied by SixApp. Where the Consumer requests that this service begin during the withdrawal period, SixApp will obtain the express request and any legally required acknowledgement concerning loss of the right after full performance. If the Consumer validly withdraws before full performance, SixApp may retain only a proportionate part of the Platform Fee for service actually supplied where the statutory conditions are met; any balance is refunded.
Where the Performer is a Non-Trader, statutory consumer rights governing the Task Agreement generally do not apply. The warning shown at Checkout does not limit rights concerning SixApp's own platform service or any right that applies for another reason.
Nothing in this Section limits remedies for non-conforming services, fraud, unauthorised payments or other mandatory rights.
12. User reviews and ratings
Reviews
Users may be permitted to submit ratings and reviews following completion of a Task. Reviews must: be truthful and based on the User's genuine experience; relate to the relevant Task or interaction; and be expressed in a fair, reasonable and non-abusive manner.
Users must not submit fake, misleading, retaliatory or manipulated reviews, including reviews intended to unfairly influence another User's rating.
Prohibited review conduct
Users must not: submit fake reviews; submit reviews in exchange for payment or other improper benefits; manipulate ratings; threaten another User with a negative review; use reviews to extort additional payment; post personal or confidential information; submit discriminatory, threatening or unlawful content.
Moderation
SixApp may remove, restrict, hide or otherwise limit the visibility of a review that violates these Terms, applicable law or Platform rules.
SixApp is not required to remove or alter a review solely because a User disagrees with its content, rating or conclusions.
Review verification
Only an Account linked by Platform records to the relevant Task may submit a review through the Task review workflow. SixApp treats that transactional link as its verification that the review was submitted by a User who used or contracted through the Platform; it does not independently verify every subjective statement in the review.
SixApp may use duplicate-Account, transaction, timing, device and content signals, together with human review, to identify and remove fake or manipulated reviews. SixApp will not state that every published review has been verified unless that statement accurately describes the implemented process.
13. User Content
User responsibility
Users remain responsible for the Content they submit, upload or otherwise make available through the Platform.
Users must have all rights, permissions and lawful grounds necessary to submit such Content and to allow SixApp to process it in accordance with these Terms and the Privacy Policy.
Users must not submit Content that is unlawful, misleading, infringing, harmful or otherwise prohibited under these Terms.
Licence to SixApp
By submitting Content to the Platform, you grant SixApp a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, display and otherwise use that Content to the extent reasonably necessary to: operate the Platform; provide Platform functionality; facilitate Tasks; provide customer support; investigate disputes; prevent fraud and abuse; maintain security; comply with legal obligations.
This licence continues for as long as reasonably necessary for those purposes and does not transfer ownership of your Content to SixApp.
Removal of Content
SixApp may remove, restrict or disable access to Content where reasonably necessary because the Content: violates these Terms; violates applicable law; infringes third-party rights; creates a safety or security risk; is fraudulent or misleading; is subject to a valid legal request.
14. Prohibited conduct, content moderation and DSA notices
Prohibited conduct
Users must not use the Platform to commit or facilitate unlawful activity; threaten, harass or discriminate; exploit a minor or vulnerable person; infringe intellectual-property, privacy or other rights; manipulate reviews or Promotions; submit malware or interfere with security; scrape or reverse engineer the Platform contrary to law; use false identity or evidence; evade payment, verification or enforcement; or otherwise create a material risk to Users or the Platform.
Reporting illegal or prohibited content
Any person may report a Task, Offer, profile, review or other User Content through the in-app reporting function or at info@sixapp.eu. A sufficiently precise notice should identify the content or Task, explain why it is considered illegal or prohibited, provide the reporting person's name and email unless a lawful exception applies, and include a good-faith statement that the information is accurate.
SixApp will acknowledge an electronic notice and assess it in a timely, diligent, objective and non-arbitrary manner. SixApp may request clarification and may remove, restrict, demote or preserve content, restrict monetisation, suspend an Account, refer the matter to a competent authority or take no action where the notice is not substantiated.
Moderation standards
Moderation may use user reports, rules-based filters, fraud and safety signals, automated prioritisation and review by trained personnel. Automated tools may identify or prioritise potential violations, but a material restriction or final appeal decision will receive meaningful human review where required by law or reasonably necessary to avoid material error.
When SixApp restricts content, an Account, visibility or monetisation because content is considered illegal or contrary to these Terms, SixApp will provide the affected User with a clear statement of reasons unless prohibited by law, necessary to protect an investigation or another lawful exception applies. The statement may identify the facts, contractual ground, use of automation, territorial scope, duration and available review route.
Review of moderation decisions
An affected User may challenge a moderation decision through the in-app appeal or support function within six months after notice, unless the Platform specifies a longer period. Review is free of charge and handled under the procedural safeguards required by applicable law.
Nothing in this Section prevents access to certified out-of-court dispute settlement, a Digital Services Coordinator, another authority or a court where available.
Points of contact
The electronic point of contact for Users, authorities and DSA communications is info@sixapp.eu. Communications may be submitted in English or Latvian. SixApp may publish a dedicated authority channel at sixapp.eu. The contact channel permits direct communication and is not limited to automated tools.
SixApp may report information giving rise to a suspicion of a criminal offence involving a threat to life or safety to the competent law-enforcement or judicial authority where legally required.
15. Identity, Trader and payment verification
SixApp may use Stripe and other qualified providers to verify identity, age, address, payment account, business status, sanctions exposure, fraud risk or other legally relevant information.
Verification is mandatory where required for a payout account, Trader traceability, DAC7, payment-provider compliance, a regulated Task category or a material safety risk. SixApp may restrict posting, offering, payment or payout until the required verification is complete.
Before allowing a Trader to offer services to Consumers, SixApp may require and make reasonable efforts to verify the Trader's name, address, telephone or email, identification or registration details, payment-account details and self-certification that the offered service complies with applicable law. Legally required Trader information will be displayed to the Customer.
Verification confirms only the checked information at the time of review. It is not an endorsement or guarantee of competence, qualifications, insurance, safety, legality or future conduct.
Users must promptly update expired or inaccurate verification information. SixApp may repeat verification where reasonably necessary.
16. Professional status, taxes and DAC7
A Performer is responsible for determining and complying with applicable economic-activity registration, licence, qualification, insurance, VAT, income-tax, social-contribution and invoicing obligations. SixApp does not provide individual tax or legal advice and does not assume those obligations merely by facilitating payment.
Repeated, organised or profit-oriented activity may cause a Performer to be treated as a Trader or person carrying on economic activity regardless of the declaration selected in the Platform. The Performer must update the status and obtain professional advice where needed.
To the extent SixApp is a reporting platform operator for relevant personal services under DAC7 and Latvian implementing rules, it will carry out the due-diligence, reporting and notification obligations described in this Section. DAC7 reporting is separate from whether a Performer is a Trader, employee or registered economic operator and does not itself impose a new tax.
For each reportable Performer, SixApp may collect and verify the legal name, primary address, date and place of birth where required, tax identification number and issuing state, tax residence, business and VAT registration details, financial-account identifier, account-holder details, consideration paid or credited, transaction count and fees, commissions or taxes withheld or charged.
The exclusion for fewer than 30 transactions and no more than EUR 2,000 applies under DAC7 to qualifying sales of goods, not to personal services performed through SixApp. A low number or value of Tasks does not by itself remove reporting obligations for personal services.
SixApp may rely on a qualified verification provider, but SixApp remains responsible for the due-diligence and reporting duties imposed on the platform operator.
If a Performer does not provide legally required DAC7 information, SixApp will send the required reminders. After the legally prescribed period, SixApp may close the Account, prevent re-registration or withhold payouts until the information is supplied, as permitted or required by law.
SixApp will report and provide the Performer with the required annual information within the applicable deadlines. Processing and retention are described in the Privacy Policy.
Nothing in these Terms determines that a Performer is self-employed or employed. Mandatory law and the actual organisation and control of work govern that determination.
17. Bonus and referral programmes
SixApp may offer Promotions through the Bonus section, a referral screen or a written campaign notice. The specific offer will state the eligible Users, start and end dates, reward amount, qualifying milestones, claim or payout conditions, expiry and any limit. Those specific terms form part of these Terms for the relevant Promotion.
Unless a Promotion expressly states otherwise, a qualifying Task must be genuine, paid through the Platform, completed without cancellation or refund, past the Review Period, free from a pending Dispute or chargeback, and performed between distinct bona fide Users in compliance with these Terms.
A Performer must complete the required identity, tax and connected payout-account verification, including Stripe Connect where used by the Platform, before a cash-equivalent bonus can be paid. A displayed pending bonus is not withdrawable until every stated milestone and verification condition is satisfied.
A referral reward is earned only when a genuinely new User registers through the valid referral method and completes the milestone shown in the referral offer. A new User may be attributed to only one referrer. Self-referral is prohibited.
The following do not qualify and may result in withholding or reversal: duplicate or controlled Accounts; self-referrals; collusion; artificial, circular or token Tasks; tasks created mainly to unlock a reward; shared payment instruments or devices used to disguise common control; manipulated location or evidence; cancellation, refund or chargeback; and any other fraud or material violation.
Promotions are funded by SixApp, are separate from the Performer Amount, are not customer funds, wages or a deposit, are not transferable and have no cash value until earned under the specific offer. The recipient is responsible for any applicable tax.
SixApp may correct an obvious calculation error and may suspend a reward while investigating reasonable fraud grounds. SixApp will provide a reason and a review route. A User may appeal a Promotion decision once through support within 14 days.
SixApp may amend or end a Promotion prospectively on reasonable notice. A verified reward already earned will not be removed solely because the Promotion ends, except in case of fraud, error, refund, chargeback or legal requirement. Promotions cannot be combined unless the offer states otherwise.
18. Safety
User responsibility for safety
Users are responsible for taking reasonable precautions when interacting with other Users and performing or requesting Tasks.
Users should assess the circumstances and any relevant risks before agreeing to or carrying out a Task and should not proceed where they reasonably believe that doing so would create a serious risk to their safety, property or legal interests.
Personal locations
Where a Task involves entering a private residence or other sensitive location, Users must exercise appropriate caution and take reasonable steps to protect their safety and property.
SixApp may impose additional requirements, verification measures or restrictions on Tasks involving heightened safety risks.
Safety disclaimer
SixApp cannot guarantee the safety, security or suitability of any User, location, Task or interaction arranged through the Platform.
Each User is responsible for assessing the risks relevant to a Task and should not start or continue a Task where they reasonably believe that doing so would expose them or another person to an unacceptable risk.
Emergency situations
SixApp is not an emergency-response, security, medical or other emergency service and does not provide emergency assistance.
In an emergency or where there is an immediate risk to health, safety or property, Users should contact the appropriate emergency services or competent authority without relying on the Platform.
19. Platform availability
SixApp will use reasonable efforts to maintain the availability and functionality of the Platform. However, the Platform may occasionally be unavailable because of: maintenance; technical failures; updates; cybersecurity incidents; telecommunications failures; third-party service failures; payment-provider issues; events beyond SixApp's reasonable control.
20. Third-party services
The Platform may rely on third-party services, including payment processors, identity verification providers, authentication providers, communication providers, cloud infrastructure and notification services.
Third-party services may have their own terms and privacy policies.
SixApp is not responsible for independent failures, acts or omissions of third-party providers except to the extent required by applicable law.
21. Limitation of liability and indemnification
General principle
SixApp provides the Platform as an intermediary technology service and does not control the performance of Tasks by Users. To the maximum extent permitted by applicable law, SixApp is not responsible for the acts, omissions, representations, qualifications, conduct or performance of Users or for the outcome of any Task Agreement.
If a User is a Consumer, SixApp is not responsible for loss that was not reasonably foreseeable when the platform agreement was made or for business loss. SixApp remains responsible for foreseeable loss caused by its breach of the platform agreement or failure to use reasonable care and skill, subject to mandatory law.
If a User acts for business purposes, then, to the maximum extent permitted by law, SixApp is not liable for indirect, incidental, special or consequential loss or for loss of profit, revenue, business opportunity, reputation, data or anticipated savings.
SixApp is not liable for loss or damage caused by circumstances outside its reasonable control, including failures or interruptions of telecommunications networks, cloud infrastructure, payment providers, authentication providers or other third-party services, except to the extent otherwise required by applicable law.
Nothing in these Terms excludes or limits SixApp's liability to the extent that such liability cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, fraud, wilful misconduct or another liability that is mandatory under applicable law.
Nothing in these Terms limits any mandatory rights or remedies available to a Consumer under applicable law.
User indemnification
To the extent permitted by applicable law, a User is responsible for and shall compensate SixApp for third-party claims, losses, damages, costs or reasonable expenses arising directly from the User's unlawful conduct, material breach of these Terms, infringement of third-party rights or misuse of the Platform, except to the extent caused by SixApp's own acts or omissions.
Nothing in this Section requires a User to indemnify SixApp for liability that is attributable to SixApp or that cannot lawfully be transferred to the User.
22. Intellectual property
SixApp rights
The Platform, including its software, design, branding, trademarks, text, interfaces, graphics, databases and other materials created or provided by SixApp, is owned by or licensed to SixApp and is protected by applicable intellectual property laws.
Except as expressly permitted by these Terms or applicable law, Users may not copy, reproduce, modify, distribute, publish, sell, license, reverse engineer or otherwise exploit any part of the Platform without SixApp's prior written permission.
Limited licence
Subject to these Terms, SixApp grants you a limited, non-exclusive, non-transferable, revocable and non-sublicensable right to access and use the Platform solely for its intended purposes and in accordance with these Terms.
This right does not grant you any ownership or other proprietary interest in the Platform or its intellectual property.
Restrictions
User must not: copy or reproduce substantial parts of the Platform; modify or create derivative works from the Platform; reverse engineer the Platform except where such restriction is prohibited by mandatory law; sell, sublicense or commercially exploit Platform functionality without authorization; remove proprietary notices; use SixApp branding without permission.
23. Account restriction, suspension and termination
SixApp may proportionately restrict content, visibility, payment, payout, a feature or an Account on the grounds stated in these Terms, including illegality, material or repeated breach, fraud, false evidence, payment abuse, non-performance, harassment, safety risk, unauthorised access, missing mandatory verification or a binding legal requirement.
Except where a lawful exception applies, SixApp will notify the affected User on a durable medium and state the material facts, contractual ground, scope, duration and available appeal. An immediate temporary restriction may be imposed where needed to prevent fraud, preserve evidence, protect safety, comply with an order or avoid material harm.
Before deciding the final measure, SixApp will consider seriousness, frequency, intent, harm, prior history, cooperation and less restrictive alternatives. Material final decisions and appeals will receive meaningful human review.
A User may appeal through the Platform or info@sixapp.eu. Successful appeals will result in prompt reinstatement of the affected access, content and available data.
Business users
If SixApp restricts or suspends a Trader business user, SixApp will provide the legally required statement of reasons before or when the measure takes effect. If SixApp terminates the entire service to a business user, it will ordinarily give at least 30 days' prior notice and reasons on a durable medium.
Advance notice may be omitted where SixApp is subject to a legal obligation requiring termination, exercises an imperative right under applicable law, addresses an immediate cybersecurity or safety risk, or can demonstrate repeated infringement justifying termination. Reasons may be withheld only where law permits.
A User may close an Account at any time subject to outstanding Tasks, payments, Disputes, chargebacks and legal retention. Closing an Account does not cancel an existing Task Agreement automatically.
24. Effect of account closure and data access
Account closure does not affect rights and obligations that arose earlier, including payment, refund, Dispute, tax, intellectual-property, liability and legal-claim provisions intended to survive.
Before closure, a User may download information made available by the Platform, including Task history, transaction records, invoices or tax statements. A business user will have a reasonable technical and contractual opportunity to access data generated through its use, subject to the rights of other persons, security and legal retention.
After closure, public profile information will be deleted or anonymised within the period stated in the Privacy Policy. Reviews may remain attributed to “Deleted user”. Access to records may be limited where required for fraud prevention, disputes, accounting, DAC7 or legal claims.
While the Account is active, a Trader business user can access the information it submitted and the Task, Offer, message, transaction, review and performance records made available through its Account. SixApp accesses those categories to operate, secure, support and improve the Platform and may provide only the necessary data to counterparties, service providers and authorities as described in the Privacy Policy. Unless law requires longer access, the export function remains available for at least 30 days after ordinary termination; active access may end immediately where justified by security, fraud or legal risk.
25. Changes to these Terms
SixApp may amend these Terms prospectively to reflect a legal or regulatory requirement, a new or changed feature, security or fraud risk, payment-provider requirement, business-model change or clarification.
The updated version will state its date and will be made available through the Platform. SixApp will give Consumers reasonable advance notice of a material adverse change and request renewed acceptance where required.
A business user will receive the proposed change on a durable medium at least 15 days before it takes effect. A longer period will be provided where reasonably necessary to make technical or commercial adaptations. The notice period does not apply where SixApp must comply with a legal obligation, address an unforeseen and imminent cybersecurity risk or another statutory exception applies.
A business user may terminate the platform agreement before the change takes effect. Written waiver of the notice period is effective only where permitted by law. Changes made contrary to mandatory P2B requirements are ineffective to the extent provided by law.
A change will not retroactively alter a formed Task Agreement unless both Users agree or mandatory law requires it. Continued use constitutes acceptance only to the extent lawful and after the applicable notice.
26. Privacy and similar technologies
SixApp processes personal data under its Privacy Policy. Users should review it before using the Platform and before uploading Completion Evidence or another person's data.
The Platform may use device storage, software development kits, authentication tokens and other technologies strictly necessary for security and operation. Optional analytics, marketing or similar technologies will be used only with any consent or notice required by law. SixApp will provide a cookie or tracking notice if the actual implementation requires one.
27. Governing law, complaints and dispute resolution
These Terms and the platform agreement are governed by Latvian law. A Consumer retains mandatory protections of the law of the country of habitual residence where applicable and is not deprived of a forum that cannot lawfully be excluded.
Complaints to SixApp
A complaint about SixApp's platform service should be submitted through support or to info@sixapp.eu with the Account details, relevant Task or transaction, facts and requested resolution. This procedure is separate from a Task Dispute under Section 10.
SixApp will acknowledge and investigate the complaint and will provide a written response within 15 working days after receipt, unless an objectively justified extension is permitted. A rejection will include reasons and available next steps.
An unresolved Latvian consumer complaint may be submitted to the Consumer Rights Protection Centre (PTAC), Brīvības iela 55, Rīga, LV-1010, Latvia, telephone +371 65452554, email pasts@ptac.gov.lv, ptac.gov.lv, and, where eligible, to the Consumer Dispute Resolution Commission. The applicable authority and procedure may change; current official information prevails.
Business-user complaints and mediation
A business user may use the internal complaint channel for alleged non-compliance with P2B obligations, technical issues or measures affecting the business relationship. SixApp will handle complaints within a reasonable period, communicate the outcome individually and publish any information required by law. Small-enterprise exemptions apply where legally available.
Where legally required and not subject to an exemption, SixApp will identify mediators with whom it is willing to engage in good faith. Mediation does not prevent court proceedings.
Court and authority rights
A Dispute between Users is initially handled under Section 10. Nothing in these Terms prevents a User from bringing a claim before a competent court or authority or using mandatory ADR. Unless mandatory law provides otherwise, courts of Latvia have jurisdiction over disputes with SixApp.
28. General contract terms
These Terms, the Privacy Policy, the accepted Task Description and Offer, information shown at Checkout and the specific conditions of an accepted Promotion constitute the relevant contractual framework. No separate Cookie Policy or Dispute Terms are incorporated as of the Effective Date unless they are made available to the User before acceptance and expressly identified as part of the agreement.
If a provision is invalid or unenforceable, it will be limited to the minimum extent necessary and the remaining provisions continue in effect. Failure to enforce a provision once is not a waiver.
A User may not assign an Account or platform agreement without SixApp's prior written consent. SixApp may assign the agreement as part of a merger, reorganisation or transfer of the Platform, provided Consumer rights are not reduced and legally required notice is given.
Notices may be delivered through the Account, email or another durable medium using the contact information on file. Users must keep that information current.
These Terms may be made available in English, Latvian or another language. The version expressly accepted by the User governs, subject to mandatory language and consumer-protection law. Where Latvian law requires information or service in Latvian, an English-language designation does not limit that requirement or any User right.
